Abstract

UNESCO¡¯s Universal Declaration on Bioethics and Human Rights(UDBHR) is expected to develop as international human rights law. So the purpose of this paper is reviewing on UDBHR in respect to legal meaning and effect to seek the direction of Korea¡¯s legislation to go. UDBHR is not international law itself and does not have binding force. But it can become international customary law and at least can be a guidance in the area of bioethics even now. In the light of UDBHR, both the present Korean legislation on bioethics and the amended bill have serious defects against the principles of UDBHR or Korean constitutional law. I suggest a new legal system on bioethics including a fundamental bioethics law and branch legislations.
